Article 19 of the Code of Criminal Procedure provides that the Judges of the Republic shall ensure their safety and protection of the Constitution of the Bolivarian Republic of Venezuela, having due regard to constitutional rule over any other law, so we have that article 44 paragraph 1 of the Constitution provides that personal freedom is inviolable and that "No person may be arrested or detained except by virtue of a warrant, unless caught red-handed ... It will be judged on freedom except for reasons determined by law and assessed by the judge in each case ... "(Underline and bold the Tribunal), in that sense, it is clear that the legislature provides a guarantee Constitutional personal freedom, which is inviolable, except for the two assumptions that the same article, the Court also notes that just as personal liberty is inviolable fact remains that the presumption of innocence is also of constitutional status and constitutes a fundamental and well established in Article 49 0rdinal 2 of our Constitution which says: "... All persons are presumed innocent until proven guilty ..." and Article 8 of the Code of Criminal Procedure which states: "Anyone who is suspected of having committed an offense is entitled to be presumed innocent, to be treated as such, until his guilt is established by a judgment ..
